New Fireworks Law

2007-13

Section 1

No Person shall ignite, fire or discharge any firecracker or other type of consumer fireworks, as defined by Ind. Code § 22-11-14, within the town limits or upon any town property or premises except between the hours (local time) of:
  1. 5:00 p.m. and two (2) hours after sunset on June 29, June 30, July 1, July 2, July 3, July 5, July 6, July 7, July 8, and July 9;
  2. 10:00 a.m. and 12:00 midnight on July 4; and
  3. 10:00 a.m. on December 31 and 1:00 a.m. on January 1.
  4. The penalty for each violation of this ordinance shall be a fine of not less than $100, nor more that $2,500 as found in § 10.99 of the Lowell Municipal Code.

Animal Ordinances

§ 92.02 LICENSE REQUIRED; EXEMPTIONS

  1. It is unlawful for any person to own, keep or harbor, have in their possession or have the care and custody of any dog over the age of six months within the corporate limits of the town unless a license is procured and kept current for each such dog as provided in this chapter.
  2. All dog licenses and kennel licenses shall be issued and valid for one-year beginning on January 1 of the same year the application is filed. Applications made on or before January 31 of each calendar year, or within 30 days after a dog attains six months of age during any calendar year, shall be without penalty. If application is not made by January 31 of each calendar year, or within 30 days of the date the dog attains the age of six months during any calendar year, the applicant shall be assessed a penalty of $5.00 in addition to the regular license fee, which amount shall be added to and collected with the regular license fee. Application shall be made to the Clerk-Treasurer on a form to be furnished by the town for then registration and licensing of the dog or dogs of such owner, and such owner shall pay the Clerk-Treasurer the license fees prescribed by § 92.03.
  3. The provisions of this section are not intended to apply to the following:
    1. Dogs whose owners are nonresidents temporarily in the town;
    2. Dogs brought into the town for the purpose of participating in any dog show;
    3. "Seeing-eye" dogs properly trained to assist blind persons when such dogs are actually use by blind persons for the purpose of aiding them in going from place to place.

§ 92.13 NOISE DISTURBANCE

Any dog which causes a serious annoyance or disturbance to the neighborhood or any of the residents therein by its loud, frequent, habitual or continued barking, howling or yelping is a nuisance.

§ 92.16 REGULATION OF CATS

Any and all regulations pertaining to dogs in this chapter shall also apply to cats.

Curfew

It is a curfew violation for a child 15, 16, or 17 years of age to be in a public place:
  1. Between 1:00am and 5:00am on Saturday or Sunday.
  2. After 11:00pm on Sunday, Monday, Tuesday, Wednesday, or Thursday.
  3. Before 5:00am on Monday, Tuesday, Wednesday, Thursday, or Friday.
It is a curfew violation for a child under 15 years of age to be in a public place after 11:00 p.m. or before 5:00 a.m. on any day.
  1. This does not apply to a child who is either…
    1. Accompanied by his parent, guardian, or custodian.
    2. Accompanied by an adult specified by his parent, guardian, or custodian.
    3. Participating in, going to, or returning from one of the following: lawful employment, a school sanctioned activity, or a religious event.
Parent or guardian responsibility
It is unlawful for any parent, guardian, or other person having custody of any person under the age of 18 years to allow or permit such child, ward or other person under such age, while under his or her legal custody, to go or be in upon any of the streets, alleys or public places in the time within the time prohibited unless there exists a reasonable necessity. Taking child into custody
  1. A child may be taken into custody by any law enforcement officer under an order of the court.
  2. A child may be taken into custody by any law enforcement officer acting with probable cause to believe that he/she is willfully violating the provision of curfew violation.
  3. No child or minor person arrested under the provisions of this section shall be placed in confinement until the parent, guardian, or other person having legal custody of such a person under the age of 18 years has been first contacted by the police department to ascertain the wishes of the parent, guardian, or other person having legal custody of such a person under the age of 18 years has refused to be held responsible for the observance of this section by the minor person.

Parking Regulations

The regulation of the municipal parking lots designated by the Town Council shall be regulated as follows:
  1. Supervision. The municipal parking lots now are hereafter acquired or established by the town shall be under the supervision of the Chief of Police.

  2. Use. It shall be unlawful to park any vehicle in any municipal parking lot in violation of this code or any other applicable ordinance of the town or to so park contrary to the rules established by the Town Council for the use of such lot or in any place or manner other than designated by the Council.

  3. Hours. It shall be unlawful to park any car or other vehicle in a municipal parking lot in the town for a continuous period in excess of 24 hours unless the car or other vehicle is parked ina handicapped parking space in ordinance with §72.06, or unless the car or other vehicle is parked within a designated area marked by appropriate pavement and/or curb stripped and the vehicle has a properly displayed parking permit obtained from the Clerk-Treasurer of the town.

  4. Parking permits. Any resident of the town who resides in the Downtown Zoning District, D-1, in a building or facility which does not have adequate off-street parking for its residents may obtain a parking permit from the Clerk-Treasurer, which permit, when properly displayed, shall permit the vehicle to be parked in the designated areas of the north parking lot and the south parking lot for periods of time in excess of 24 hours. Parking permits shall be issued on a calendar year basis and shall be valid from the date of issuance through December 31 of any year. The annual parking permit fee shall be $10, which fee shall be prorated on a monthly basis for any permit issued for less than 12 months. Parking permits shall only be issued for operating vehicle duly licensed in the state. The issuance of a parking permit by the town shall not be construed to guarantee parking space availability at any time, nor shall anything contained in this section be construed to alter or otherwise affect the abandoned vehicle provisions of Chapter 90 of this code of ordinances. The use of the designated parking area shall be subject to such rules and regulations for snow removal, routine maintenance, and the like, as the Town Council may establish from time to time.

  5. Overnight guests of downtown parking permit holders are required to contact the Lowell Police Department at 219-696-0411 and report the visitor's vehicle description, registration, renter's name, address, and phone number. If you fail to do so, the vehicle may be cited and/or towed at the owner's expense in accordinance to the ordinance.
